SONKA is a technology platform only. SONKA does not own vehicles, employ drivers, carry goods, store goods, guarantee deliveries, or perform transport of any kind. When you use the Platform, SONKA may display drivers, allow you to contact them, show locations, allow messaging, facilitate bookings and support ratings.
All transport, carriage, loading, delivery, handling, storage and custody of goods is performed exclusively by the driver you choose — who is an independent contractor, not an employee or agent of SONKA. Any contract to carry goods is between you and the driver. SONKA is not a party to that contract.
You are solely responsible for inspecting, confirming and satisfying yourself about any driver, vehicle, licence, price, qualifications, insurance and suitability before handing over any goods or making any payment. SONKA does not verify, background-check, vet or guarantee any driver, vehicle, document, photo, rating or price shown on the Platform. You should inspect the vehicle, confirm the driver's identity, confirm the agreed price, and keep your own record of every transaction.
You must not use SONKA to request, transport, solicit, ship, or arrange the movement of any prohibited, illegal, stolen, counterfeit, dangerous, hazardous, regulated or restricted item, including without limitation:
Violation of this section may result in immediate account termination, referral to law enforcement and full liability for any resulting loss.
You agree that you will:
Any loss, damage, theft, delay, non-delivery, short delivery, misdelivery or destruction of goods while in the care of a driver is the responsibility of that driver, not SONKA. SONKA is not a carrier, insurer or guarantor. Your remedy for any such event lies against the driver directly. Where the Platform offers a dispute tool, SONKA may, at its sole discretion, facilitate mediation between you and the driver, but SONKA does not guarantee any outcome, compensation, refund, replacement, repair or remedy.
You are strongly advised to obtain appropriate goods-in-transit insurance at your own cost for any valuable shipment.
SONKA does not guarantee that any driver, vehicle type, price, location, delivery time, service quality or safety standard will be available at any time. Coverage, choice, speed, price and quality may vary and may change without notice.
You may rate and review drivers after any interaction. Ratings and reviews must be your honest opinion. SONKA may moderate, remove or retain ratings, reviews and chat messages at its sole discretion. You grant SONKA the Content Licence described in the Terms of Service for any ratings, reviews, messages, photos or other Content you submit. SONKA is not liable for any Content posted by another User.
SONKA may suspend, restrict or terminate your account at any time, with or without cause, with or without notice, at its sole and absolute discretion, including where you breach this Agreement, the Terms of Service, or any law, or where you engage in fraud, dispute abuse, chargebacks, prohibited-goods activity, or conduct inconsistent with safe operation of the Platform.
The Disclaimers, Limitation of Liability, and Indemnification provisions in the Terms of Service are fully incorporated into this Agreement and apply to you as a Customer. Without limitation, SONKA and the Indemnified Parties (as defined in the Terms of Service) shall not be liable for any loss, damage, theft, injury, delay, disappointment or claim arising out of or related to your use of the Platform, any driver, any vehicle, any Content, any payment or any transaction.
Any price, promotional claim, marketing copy, illustrative example, case study or forecast shared by SONKA is illustrative only. SONKA makes no promise or guarantee about the price you will pay, the time your goods will take, the quality of your experience, or the outcome of any booking.
This Agreement is governed by the laws of the Republic of Ghana. Any dispute, controversy or claim arising out of or relating to this Agreement, the Platform or your use of any driver service arranged through the Platform shall be resolved by binding arbitration in Accra, Ghana under the Alternative Dispute Resolution Act, 2010 (Act 798), on the same terms as set out in the Terms of Service, including the class-action waiver and the informal-resolution requirement.
By selecting "customer" during signup, ticking the acceptance box, initiating a booking, or continuing to use the Platform, you provide your electronic signature under the Electronic Transactions Act, 2008 (Act 772) of Ghana, and you are legally bound by this Agreement.
SONKA may modify this Agreement at any time by posting the updated Agreement on the Platform or website. Continued use after a change is acceptance of the change.
